Mount Ephraim Court, Tunbridge Wells

We have owned a flat in Mount Ephraim Court in Tunbridge Wells now for almost 5 years, during that time we have had a nightmare obtaining any service from the company officials (Managing Agent or the Company Directors); to include but not limited too, emergency repairs to the roof, and bedroom window, smell from drains each summer where they need dredging, leaking and blocked drainpipes, service charge certificates and access to the accompanying accounting information. All of which we are entitled too.

The matter started in Sept 2006, at an General Meeting, when one of the Directors was challenged on why his partner was being paid for cleaning of the property when no cleaning was being undertaken. Ironically an amount that was similar to the service charge. Since then we have been subjected to a with drawl of service, barrage of abuse, false accusations and subject to criminal damage of the property including my car which has been damaged more than 10 times; the latter maybe a co-incidence but after each legal milestones. After the LVT hearing and judgement a couple of months ago, my car was scratched and the tyre's of a hire car let down. Talking to previous long standing residents, not something that has been limited to me but a number of residents who have also challenged the status quo many years prior to moving into the building.

Due to the continued neglect and personal bad behaviours of the Managing Agent who has failed to provide an adequate service and the Director who has failed to act appropriately, with the company's interest and without bias, also hiding behind each other has meant we and the company continue to expend and extortionate amount of money on legal fees. As if one civil case and a LVT hearing, in my favour were not enough to persuade the company officials to honor the lease agreement and other entitlements .

There must be a call for the government to regulate managing agents and stamp out bad behaviours. Also, take a good look at the bodies like ARMA who despite the fact state that they do not accept bad behaviours of agents, stand by them, encouraging further bad behaviours.

Thank heavens for organisations such as the LVT, who are extremely professional, knowledgeable and a god send.
